Terms of Service

1. Acceptance of Terms

By accessing or using PortraitAI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including visitors, registered users, and paying subscribers.

2. Description of Service

PortraitAI is an AI-powered portrait generation platform. Users upload personal photos to train a custom AI character model (powered by Higgsfield Soul ID) and generate synthetic portrait images using that model. The Service is provided on a subscription and free-tier basis.

3. Eligibility

You must be at least 18 years old to use this Service. By creating an account, you confirm that you are 18 or older and have the legal capacity to enter into these terms.

4. User Content and Photos

You retain ownership of all photos you upload. By uploading photos, you grant PortraitAI a limited, non-exclusive license to process and store them solely for the purpose of training your AI character model and generating portraits.

You agree that you will only upload photos of yourself or individuals for whom you have explicit consent. You must not upload:

• Photos of minors
• Photos of other people without their explicit written consent
• Photos containing explicit, illegal, or harmful content
• Content that infringes any third-party intellectual property rights

5. Generated Content

AI-generated portraits produced using your character model are owned by you, subject to these terms. You may use generated portraits for personal and commercial purposes, including social media, marketing, and profile photos.

You agree not to use generated portraits to impersonate, defame, or mislead others, or for any unlawful purpose.

6. Subscriptions and Payments

Paid plans are billed in advance on a monthly basis. Payments are processed by Paddle, our authorized reseller. All prices are in USD unless stated otherwise.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access until that date. We do not provide refunds for partial billing periods.

We reserve the right to change pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

7. Prohibited Uses

You agree not to:

• Use the Service to generate non-consensual intimate imagery (NCII)
• Attempt to reverse-engineer, scrape, or abuse the API
• Use automated tools to circumvent rate limits or usage quotas
• Resell or redistribute access to the Service
• Use the Service in violation of any applicable law

8. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms. Upon termination, your right to use the Service ceases and we may delete your data in accordance with our Privacy Policy.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that generated images will meet any specific standard of quality or likeness.

10. Limitation of Liability

To the maximum extent permitted by law, PortraitAI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Changes to Terms

We may update these Terms at any time. We will notify you via email or a notice in the app for material changes. Continued use of the Service after changes are posted constitutes acceptance.
